The Enforcement Section of the Planning Department enforces the provisions of the City-County Zoning Ordinance. Most enforcement actions are complaint driven. Citizens can help the Enforcement Officers by reporting an incident that should be investigated and giving the location and the time of day when the Enforcement Officer is most likely to see the activity. Complaints frequently relate to temporary signs, vehicle repair operations in a residential area, building setback issues and fence heights. An enforcement officer will investigate any complaints received to verify that a violation exists. If a violation is discovered, the property owner is given a Notice of Violation and informed of actions that need to be taken. Owners are then given a period of time to correct the violation. If the corrections are not made within the specified time, civil penalties may ensue. The owner also has the right to appeal the violation notice to the Board of Adjustment or to the Courts.
