About the Board
The Board of Adjustment (BOA) holds quasi-judicial public hearings to determine requests made by property owners in the City and County of Durham for minor and design special use permits, variances, and appeals of administrative interpretations or decisions as authorized by state law and local ordinance. The BOA is comprised of 10 members appointed by the Durham City Council and the Board of Commissioners.
Membership Requirements
The board consists of 7 members and 3 alternates. The Durham City Council appoints 4 members and 1 alternate. All must reside within the corporate city limits. City and County taxes must not reflect any delinquency at the time of submission of the application. The Board of County Commissioners also appoints 3 members and 2 alternates, of whom at least 3 must reside outside the City limits.
Board members must be willing to set aside 1 day a month to serve. Members serve without compensation. Applications for appointment can be obtained from the City Clerk's office or the County Clerk's office.
