Public hearings will be held to discuss the following: Annexation - 1051 Olive Branch Road (BDG2000016), Bertha Gamble Residence (BDG2000024), Project Sweet (BDG2000026), Lumley Road (BDG2000027); Zoning Map Change - 1051 Olive Branch Road (Z2000028); Proposed Expenditure for Economic Development to CARsgen; Resolution Approving the Issuance by the Public Finance Authority of its Educational Facilities Revenue Bond (Duke School), Series 2021; City of Durham Housing Code Text Amendment due to NCGS Chapter 160D; and City of Durham Unsafe Buildings Code Text Amendment due to NCGS Chapter 160D.
The Durham City Council will hold virtual public hearings on June 21, 2021, at 7 p.m. to hear the following requests.

Annexation
- 1051 Olive Branch Road (BDG2000016) is a request for a voluntary contiguous annexation of one parcel of land totaling 79.478 acres located at 1051 Olive Branch Road.

Bertha Gamble Residence (BDG2000024) is a request for a voluntary non-contiguous annexation of one parcel of land totaling 16.496 acres located at 1518 Hamlin Road.
- Project Sweet (BDG2000026) is a request for a voluntary non-contiguous annexation of one parcel of land totaling 5.52 acres located at 1 Litho Way.
- Lumley Road (BDG2000027) is a request for a voluntary contiguous annexation of two parcels of land totaling 7.52 acres located at 5605 and 5513 Lumley Road.
Zoning Map Change
- 1051 Olive Branch Road (Z2000028)?is a request to change the zoning located at 1051 Olive Branch Road from Rural Residential (RR) to Planned Development Residential 3.700 (PDR 3.700) and a proposed change of the Future Land Use Map designation from Very Low Density Residential, Recreation and Open Space to Low Density Residential, Recreation and Open Space.

Proposed Expenditure to CARsgen
The City Council for the City of Durham will hold a virtual public hearing to receive comments on a proposed expenditure for economic development in the amount of two hundred, fifty-six thousand dollars ($256,000) to CARsgen over a three (3) year period to create a minimum of 128 new jobs and make approximately $97 million in capital investments.

#14724 - Resolution Approving the Issuance by the Public Finance Authority of its Educational Facilities Revenue Bond (Duke School), Series 2021
This is a public hearing for purposes of the federal Tax Equity and Fiscal Responsibility Act ("TEFRA"), as required by section 147(f) of the Internal Revenue Code, regarding the possible issuance of one or more series of its Revenue Bonds Series 2021 in an aggregate principal amount of not to exceed $10,000,000.
The Public Finance Authority (PFA) is a governmental unit of the State of Wisconsin created for the purpose of issuing tax-exempt and taxable conduit bonds for public and private entities nationwide. PFA is sponsored by the National Association of Counties, the National League of Cities, the Wisconsin Counties Association and the League of Wisconsin Municipalities. Any debt issued is not debt of the City or PFA, but rather is payable solely from debt service payments received from the entity involved (in this case, the Borrower). Other projects financed by PFA include: Durham Academy, Incorporated in Durham, The Hill Center, Inc. in Durham, Carolina Friends School in Durham, St. David’s School in Raleigh, the Raleigh Montessori School and WakeMed in Raleigh (partial listing). Approximately 175 North Carolina projects have been financed by PFA.
PFA has been requested to issue the Bonds pursuant to Section 66.0304 of the Wisconsin Statutes, as amended, in the principal amount of up to $10,000,000. The proceeds of the Bonds will be loaned to the Borrower to be used to (a) refund in advance of their maturity the Borrower’s obligations with respect to the North Carolina Capital Facilities Finance Agency Variable Rate Educational Facilities Revenue Refunding Bonds (Duke School), Series 2012, the proceeds of which were used to refinance and finance the Prior Project (as defined below); (b) finance the Current Project (as defined below), and (c) finance certain issuance costs to be incurred in connection with the Bonds.
The City has no obligation to repay any of these bonds, nor will the issuance of these bonds have any financial impact on the City. The City Council is being asked to approve this item only because of federal tax law and the fact that the project being financed is located within the Durham city limits. As such, the staff have not reviewed the details of the project, nor evaluated its financial feasibility.

The amendments are identified as necessary corrections, clarifications, re-organization, or other minor changes to comply with 160D. Only modifications to state statute references are included in the proposed amendments.
