Approved Text AmendmentsTC1800010 (Neighborhood Protection Overlay Revisions)- Approved by City Council on June 10, 2020 - effective NOW within the City limits. (The Durham County Board of County Commissioners will tentatively vote on the item on July 13, 2020). TC1900006 (Omnibus 14)- Approved by City Council on June 15, 2020 - effective July 1st within the City limits. (The Durham County Board of County Commissioners will tentatively vote on the item on July 13, 2020).
Safer-at-Home Order in Effect - Planning and Development Services (DSC) Continue Most Operations OnlineThe Development Services Center (DSC) lobby has been closed to walk-in customers due to COVID-19, and customer service, development review, and inspections services have continued remotely. After further assessing the safety and demand for in-person services in light of alternative telephone, email, and web-based services available, DSC management has decided to extend the lobby closure through July 6, 2020.
Any modifications to this timeline will be announced prior to July 6.
If a service cannot be provided remotely, an in-person option may be arranged in advance with strict adherence to social distancing standards and use of a face covering. As more programs and services return, and businesses reopen, we remind everyone to adhere to Durham’s Safer-at-Home Order that went into effect June 1. Durham Board of Adjustment The Durham City-County Board of Adjustment will hold a virtual public hearing on June 30, 2020, at 8:30 a.m. to hear the following requests in quasi-judicial hearings: - B20000010 – City: A request for a variance from the street and rear yard setback requirements in order to construct a single-family dwelling. The subject site is located at 2117 Ashe Street, is zoned Residential Urban-5(2) (RU-5(2)), and in the Urban Tier.
- B2000011 – City: A request for a variance from the rear yard setback requirement in order to construct a single-family dwelling. The subject site is located at 1005 Rock Street, is zoned Residential Urban-5(2) (RU-5(2)), and in the Urban Tier.
- B2000013 – City: A request for variances from the project boundary buffer along the right-of-way, the project boundary buffer between two zoning districts, and the tree coverage requirements for the demolition and reconstruction of a restaurant. The subject site is located at 4301 N. Roxboro Street, is split-zoned Commercial General (CG) and Commercial Neighborhood (CN), in the Falls of the Neuse/Jordan Lake Protected Area (F/J-B) Watershed Protection Overlay, and in the Suburban Tier.
- B2000014 – City: A request for a minor special use permit to allow the location and size of future construction of buildings to the existing museum site. The subject site is located at 433 W. Murray Avenue, 707 W. Murray Avenue, and 115 W. Brittania Avenue. The site is split-zoned Residential Urban-5(2) (RU-5(2)), Residential Suburban-8 (RS-8), and Commercial General (CG). It is located within the Falls of the Neuse/Jordan Lake Protected Area (F/J-B) Watershed Protection Overlay and in the Urban Tier.
- B2000015 – City: A minor special use permit to allow for a 6-foot-tall chain-link fence with barbed-wire in the street frontage of the subject properties. The subject site is located at 5203 and 5325 Chin Page Road, zoned Industrial Light with a development plan (IL(D)), and in the Suburban Tier.
- B2000016 – City: A request for a variance for a reduced street yard setback. The subject site is located at 1022 Ninth Street, is zoned Residential Urban-5(2) (RU-5(2)), located in the Old West Neighborhood Protection Overlay, and in the Urban Tier.
- B2000017 – City: A request for a minor special use permit to allow for a 6-foot-tall fence in the street frontage of the subject property. The subject site is located at 110 East Markham Avenue, is zoned Residential Urban-Multifamily (RU-M), in the Falls of the Neuse/Jordan Lake Protected Area (F/J-B) Watershed Protection Overlay, and in the Urban Tier.

Plan Amendment- 1432 Ellis Road (A1800011), generally located at located at 1432 Ellis Road, is a request to change the future land use map designation from Low Density Residential, Open Space and Recreation to Low-Medium Density Residential, Open Space and Recreation.
Zoning Map Changes - 1432 Ellis Road (Z1800035), generally located at located at 1432 Ellis Road, is a request to change the zoning from Rural Residential (RR) and Residential Suburban-20 (RS-20), County Jurisdiction to Planned Development Residential 5.706 (PDR 5.706), City Jurisdiction.

- 2419 West Club Boulevard (COA2000021) is a request for an enclosure of a side porch into a sunroom; conversion of an original side window into a door.
- 1308 Fayetteville Street (COA2000025) is a request for construction of front entrance vestibule; installation of light-permeable cladding across window area of front elevation; replacement of front and side walkways, and installation of a knee wall; installation of a monument sign at the ROW.

Durham County Board of County CommissionersMonday, July 13, 2020, 7:00 p.m. Virtual Session The Board of County Commissioners will hold a virtual meeting, July 13, 2020 at 7:00 p.m. to consider the following: UDO Text Amendment - TC1800010 – NPO Revisions – Amendments to Article 2, Review Authority; and Article 4, Zoning Districts, regarding revisions to the Neighborhood Protection Overlay (NPO) process.
- TC1900005 – Affordable Housing Dwelling Unit Definition - amend the current definition of an “affordable housing dwelling unit” within Sec. 17.3, Defined Terms, of the Unified Development Ordinance (UDO).
- TC1900006 - Omnibus Changes 14 - technical revisions and minor policy changes to various provisions of the Unified Development Ordinance (UDO).
Zoning Map Changes - Royals Extension (Z1900013) is a request to change the zoning district at located at 2622 South Miami Boulevard and 2120 Brunson Road from Industrial Light (IL), Commercial Neighborhood (CN), Residential Suburban-20 (RS-20) to Industrial Light (IL). There is no change to the existing IL area.
Local Review Criteria Update These updates/amendments will impact all properties within designated local historic districts and local historic landmarks. Examples of updates include: modifications regarding regulation of solar panels, building massing, additions, and landmark signs. The updates to the Local Review Criteria will also include adding references to the Golden Belt Preservation Plan (approved after the original adoption of the Local Review Criteria in 2016).
