The Board of County Commissioners will hold public hearings on March 13, 2023, at the meeting beginning at 7:00 p.m. in the Commissioners' Chambers, 2nd Floor, Durham County Administration I, 200 E. Main Street to hear the following requests:
Zoning Map Changes:
- Kempski Milstead (Z2200026) is a request to change the zoning from Residential Rural with a Development Plan (RR(D)), Falls/Jordan District-B (F/J-B) to Residential Rural (RR), Falls/Jordan District-B (F/J-B); located at 220 and 214 Riley Drive.
- Blanchard Property (Z2200046) is a request to change the zoning from Residential Rural (RR) and Commercial General (CG), Falls/Jordan District-B (F/J-B) to Commercial General (CG), Falls/Jordan District-B (F/J-B); located at 2935 US 70 Highway East.

Public Participation: Residents may attend in person, via Zoom, or watch live on the County’s website and on DTN. Seating is limited inside the Chambers due to social distancing guidelines, and is on a first-come, first-serve basis, with priority given to County staff. A low-capacity overflow seating area is provided in the lobby on the second floor of the Administration Building. Individuals seated in the lobby can view the meeting on screens. Residents who wish to observe meetings are encouraged to continue using the virtual option.
Residents may deliver comments on agenda items for the meeting in person or virtually. Please refer to the following web page for ways to participate: Commissioner Meetings. The Zoom meeting link will be posted during the week before the scheduled meeting.

Rebroadcasts of the meeting are available on the Durham Television Network on Spectrum Channel 8, AT&T U-verse Channel 99, Google Fiber Channel 8, and Frontier Communications Channel 70. The Durham Planning Commission will hold in-person and virtual public hearings on March 14, 2023, at 5:30 p.m. in the City Council Chambers, 1st Floor, 101 City Hall Plaza, to hear the following:
Zoning Map Changes:
- Southpoint Mall (Z2200028) is a request to change the zoning from Commercial Center with a development plan (CC(D)) and Residential Rural (RR) to Commercial Center with a Development Plan (CC(D)); located at 6910, 6920, 6930, 6940, 6950, 6960, Fayetteville Road and 8060 Renaissance Parkway.
- Harlowe Point (Z2200032) is a request to change the zoning from Residential Suburban-20 (RS-20) and Planned Development Residential 4.001 (PDR 4.001) to Planned Development Residential 3.949 (PDR 3.949); located at 1005, 1009, 1011, 1019, 1023 South Mineral Springs Road and 3712 Holder Road.

UDO Text Amendment:
- Pet Waste Receptacles (TC2200006) This text amendment proposes revisions to the Open Space (Section 7.2) standards, Utility and Solid Waste Collection Facilities standards (Section 7.6), and Screening standards (Section 9.7) within the Unified Development Ordinance (UDO) in order to address ongoing concerns regarding Total Maximum Daily Loads (TMDL) of pollutants allowed to enter a water body and associated contamination of the drinking water supply.

Annexations:
- Wesley Downs (BDG2100006) is a request for a non-contiguous voluntary annexation of eight parcels of land totaling 61.119 acres located at 312, 325, 344, 401, 409, 415 and 417 Broach Road, and 4420 Holder Road.
- Shady Grove Assemblage (BDG2100008) is a request for a non-contiguous voluntary annexation of six parcels of land totaling 78.124 acres located at 2901 and 2704 Shady Grove Road, 4001 and 4031 Carpenter Pond Road, and 2801 Olive Branch Road.
Zoning Map Changes:

- Shady Grove Assemblage (Z2100016) is a request to change the zoning from Residential Rural (RR), Falls/Jordan District-B (F/J-B) and A60 Airport Overlay (A60), County Jurisdiction to Planned Development Residential 5.632 (PDR 5.632), Falls/Jordan District-B (F/J-B) and A60 Airport Overlay (A60), City Jurisdiction; located 2901 and 2704 Shady Grove Road, 4001 and 4031 Carpenter Pond Road, and 2801 Olive Branch Road.
Development Agreement:
- Novel University Hill (Z2100048) is a request for the City of Durham to enter into a statutory development agreement with Dan Gualtieri, of Crescent Communities, to allow for an increase in the allowed density in exchange for the financing of 66 affordable units on the Carver Street Assemblage project. The applicant proposes to construct a maximum of 291 additional units above the allowed density of 109 units. The proposed benefits to the City include financing for 66 units of the Carver Street Assemblage project, the donation of parcels to Habitat for Humanity of Durham, LLC, a $50,000 donation to GoDurham/GoTriangle for a new bus shelter, and construction of new sidewalks that link the bus stop to the development.
UDO Text Amendment:
- Simplifying Codes for Affordable Development (TC2200001) is a privately initiated request to amend various provisions of the Unified Development Ordinance (UDO) to incentivize affordable housing and to allow additional flexibility in siting and design, predominantly targeted at developing infill housing and small-scale commercial opportunities. Please note: The City Council may continue this case to a future meeting without discussion.
