Temporary Updates to Review Timeframes

Due to the vacancies within our organization, Durham Development Services has temporarily revised review timelines for several review processes. These extended timeframes will allow us to provide and meet clear expectations for when comments or approvals will be distributed to applicants. Please see the 2023 Development Review Timelines (PDF) for more information.

Update on TC2200001, Simplifying Codes for Affordable Development (SCAD)

The City Council has postponed its consideration of the SCAD proposal. The previously scheduled public hearing for this item will not be held on May 1 as previously advertised. Staff is working to reschedule the public hearing and the new date will be advertised once confirmed.

Applicant-Sponsored Neighborhood Meetings

There are no scheduled applicant-sponsored neighborhood meetings at this current time.

The information found under this section of Applicant Sponsored Meetings is provided only as an additional form of notice and is not a requirement of the Unified Development Ordinance (UDO). The Planning Department shares meeting information provided by applicants as a courtesy only. As such, if a meeting is not listed here due to an oversight on the part of the applicant or the Planning Department, the meeting can still be held as long as all UDO mailed notice requirements were met per UDO paragraph 3.2.3, https://durham.municipal.codes/UDO/3.2.3.

Engage Durham

Durham's New Comprehensive Plan Update

Durham is working on a new Comprehensive Plan, a long-range vision for our community! The Comprehensive Plan guides what can be built where in Durham. 

Share your input on the new Comprehensive Plan at an upcoming public hearing!

Online engagement is now closed – any additional feedback can now be provided directly through the public hearing and adoption process.

Staff will be organizing and publicizing all the community input received during the last 2 months of engagement. This information will be provided to the Planning Commission, the City Council, and the Board of County Commissioners as part of the public hearing and adoption process.

The formal adoption process for the Comprehensive Plan began on Tuesday, February 28, 2023, at a meeting of the Planning Commission. The second public hearing before the Planning Commission was held on Tuesday, March 28, 2023. The Planning Commission continued this public hearing to their April 11 regular meeting where only Commission discussion occurred. The final opportunity for public comment will be at a special Planning Commission meeting on Tuesday, May 23, 2023, beginning at 5:30 p.m. Participation is possible either in person or virtually through Zoom. Durham County Board of County Commissioners

The Board of County Commissioners will hold public hearings on April 24, 2023, at the meeting beginning at 7:00 p.m. in the Commissioners' Chambers, 2nd Floor, Durham County Administration I, 200 E. Main Street to hear the following requests:

Zoning Map Change:

  • Leesville Storage (Z2200037) is a request to change the zoning from Commercial General with a Development Plan (CG(D)) and Residential Rural (RR) to Commercial General with a Development Plan (CG(D)); located at 4615 and 4627 Leesville Road.

UDO Text Amendment:

  • Pet Waste Receptacles (TC2200006) proposes revisions to the Open Space (Section 7.2) standards, Utility and Solid Waste Collection Facilities standards (Section 7.6), and Screening standards (Section 9.7) within the Unified Development Ordinance (UDO) in order to address ongoing concerns regarding Total Maximum Daily Loads (TMDL) of pollutants allowed to enter a water body and associated contamination of the drinking water supply.

Public Participation: Residents may attend in person, via Zoom, or watch live on the County’s website and on DTN. Seating is limited inside the Chambers due to social distancing guidelines, and is on a first-come, first-serve basis, with priority given to County staff. A low-capacity overflow seating area is provided in the lobby on the second floor of the Administration Building. Individuals seated in the lobby can view the meeting on screens. Residents who wish to observe meetings are encouraged to continue using the virtual option.

Residents may deliver comments on agenda items for the meeting in person or virtually. Please refer to the following web page for ways to participate: Commissioner Meetings. The Zoom meeting link will be posted during the week before the scheduled meeting. 

All Board of County Commissioner meetings and other Durham County content are available for viewing on the Durham County YouTube Channel. The Durham City-County Board of Adjustment will hold public hearings on April 25, 2023, at 8:30 a.m. in the Committee Room, Second Floor, 101 City Hall Plaza, to hear the following requests in quasi-judicial hearings:

  • B2300008 – City: (Continued from March 28, 2023)  A Variance from the tree preservation standards. The property is located at 2705, 2725 East US 70 Highway; 4309, 4708 Leesville Road, zoned Planned Development Residential 5.949 (PDR 5.949), in the Falls/Jordan District B (F/J-B) Watershed Overlay District, and within the Suburban Development Tier. 

  • B2300012 – City: A Variance from the minimum lot width standards. The property is located at 3730 Old Chapel Hill Road, zoned Residential Suburban – 20 (RS-20) and Residential Suburban – 8 (RS-8), and within the Suburban Development Tier. 

  • B2300013 – City: A Variance from the rear yard setback standards.  The property is located at 24 White Spruce Court, zoned Residential Urban – 5 (with a Development Plan) (RU-5(D)), and within the Suburban Development Tier. 

  • B2300014 – County: A Variance from the minimum side yard setback standards. The property is located at 9 Trappers Court, zoned Residential Rural (RR), in the Eno River District B (E-B), and within the Suburban Development Tier. 

  • B2300015 – City: A Variance from the public space and canopy tree standards. The property is located at 704 West Pettigrew Street and 604 Burch Avenue, zoned Downtown Design – Support 1 (DD-S1) ,and within the Downtown Development Tier. 

  • B2300011 – City: A request for a Minor Special Use Permit to allow for a new building for an existing place of worship in a residential zoning district. The property is located at 2403 Lednum Street, zoned Residential Urban – Multi-family (RU-M), in the Falls/Jordan District B (F/J-B) Watershed Protection overlay, and within the Urban Development Tier.

  • Simplifying Codes for Affordable Development (TC2200001) is a privately initiated request to amend various provisions of the Unified Development Ordinance (UDO) to incentivize affordable housing and to allow additional flexibility in siting and design, predominantly targeted at developing infill housing and small-scale commercial opportunities.

  • FY24 Planning Department Work Program

Residents may attend in person, via Zoom, or watch live on the County’s website and on DTN. Durham City Council

The Durham City Council will hold in-person and virtual public hearings on May 1, 2023, at the meeting beginning at 7:00 p.m. in the City Council Chambers, 1st Floor, 101 City Hall Plaza.

No cases will be presented by the Planning Department.
  
Public Participation: Regular business meetings will take place in the City Council chambers and virtually via Zoom, unless otherwise noted on the City of Durham website. Virtual participation is encouraged. To participate using the Zoom virtual meeting platform, see the agenda for the Council session. The Zoom link is at the top of the agenda. Agendas are posted the Thursday prior to the public hearing. Registration to speak during the City Council Meeting on an agenda item that is not a public hearing must be submitted by 2:00 p.m. on the day of the City Council Meeting. The Durham Historic Preservation Commission will hold in-person public hearings on May 2, 2023, at the meeting beginning at 9:00 a.m. to consider the following requests in quasi-judicial hearings:

Certificates of Appropriateness:

  • 1209 Vickers Ave (COA2300015) (Continued from April 4, 2023) is a request for new construction of an accessory structure. 
  • 104 City Hall Plaza (COA2300019) is a request for an addition and modifications.

The Board of County Commissioners will hold public hearings on May 8, 2023, at the meeting beginning at 7:00 p.m. in the Commissioners' Chambers, 2nd Floor, Durham County Administration I, 200 E. Main Street to hear the following requests:

UDO Text Amendment:

  • Improving Access and Walkability (TC2100007) proposes revisions to the requirements within the Unified Development Ordinance (UDO) to improve access and walkability in Durham. Last summer, the Durham Planning Commission initiated a text amendment with the goal of making a more connected community. To achieve this goal, the amendment proposes various rules for developers which would limit the length of streets and promote more pedestrian connections to nearby, existing networks. Specifically, the amendment includes updates to the existing connectivity ratio that ensures developers are providing sufficient road and pedestrian networks within new developments and adequately connecting to adjacent areas or neighborhoods. The amendment also includes a new block length component which limits the allowed length of the streets or street blocks that developer can build to help ensure our communities are built to human scale, closely connected, and walkable.

Zoning Map Changes: 

  • 4000 Sancar Way (Z2200053) is a request to change the zoning from Office and Institutional (OI) to Science Research Park-Center (SRP-C) located at 4000 Sancar Way.
