Board of Adjustment

Tuesday, April 23, 2019, 8:30 a.m.

The Durham Board of Adjustment will hold a public hearing on April 23, 2019, at 8:30 a.m. in the Committee Room, 2nd Floor, City Hall, 101 City Hall Plaza, to hear the following requests:

  • Case B1900008 – City: Request for a minor special use permit to construct a new single-family home within the existing building footprint of a legal non-conforming structure that is taller than the existing structure and allow an increase of greater than 10% of the existing floor area. The site is located at 921 Burch Avenue; is zoned Residential Urban-5(2) (RU-5(2)); and in the Urban Tier.
  • Case B1800031 – County: Request for variances to allow encroachment into the required side yard setback and 10-foot no-build riparian buffer setback. The site is located at 3514 Grimes Avenue; is zoned Residential Suburban-20 (RS-20), Falls Jordan District B Watershed Overlay (F/J-B); and in the Suburban Tier.
  • Case B1900011 - City: Request for a variance to decrease two required street yards and the rear yard setback in order to construct a single-family dwelling on a corner lot. The site is located at 1101 Hazel Street; is zoned Residential Urban-5(2) (RU-5(2)); and in the Urban Tier.
  • Case B1900012 – City: Request for a variance to decrease the required rear yard and street yard setbacks in order to construct a single-family dwelling. The site is located at 1103 Hazel Street; is zoned Residential Urban-5(2) (RU-5(2)); and in the Urban Tier.
  • Case B1900013 - City: Request for a variance to permit the installation of open planters along a portion of the sidewalk associated with the site. The site is located at 515 W Pettigrew Street; is zoned Downtown Design – Core (DD-C); and in the Downtown Tier.

Substantial changes to the proposed action may be made following the public hearing.  The Chair reserves the right to limit repetitive or hearsay testimony.

Monday, May 6, 2019, 7:00 p.m.

The Durham City Council will hold a public hearing on May 6, 2019, at 7 p.m. in the City Council Chambers, 1st Floor, 101 City Hall Plaza, to hear the following requests:


Unified Development Ordinance (UDO) Text Amendment

  • TC1800005 – Tree  and Landscape Revisions: Amendments to tree coverage and landscape/buffer requirements in Articles 8; Environmental Protection, Article 9, Landscaping and Buffering; Article 17, Definitions; and other associated sections.
  • TC1800009 – Compact Suburban Design District: Amendments to Article 16, Design Districts, and other associated sections, to establish new standards for the proposed Compact Suburban Design (CSD) zoning district, and other technical amendments to current Design District zoning standards. Note: This text amendment is associated with zoning map change Z1800030 Patterson Place Design District.

Annexation Petition

  • November Drive (BDG1600016): Located southeast of the intersection of Umstead Road and November Drive; a voluntary annexation petition to annex property into the City of Durham.

Zoning Map Changes

  • November Drive (Z1700028A): Located southeast of the intersection of Umstead Road and November Drive; a request to change the zoning district from Residential Rural (RR), Eno River Watershed Protection Overlay District-B (E-B), County Jurisdiction to Residential Rural (RR), Eno River Watershed Protection Overlay District-B (E-B), City Jurisdiction.
  • Patterson Place Design District (Z1800030): Located near the intersection of Interstate 40 and US Highway 15-501, parcels within or partially within the Compact Neighborhood Tier; a request to change the existing zoning districts from Commercial Center with a Development Plan (CC(D)), Commercial Neighborhood with a Development Plan (CN(D)), Commercial General with a Development Plan (CG(D)), Commercial General (CG), Commercial Neighborhood (CN), Mixed Use (MU), Mixed Use with a Development Plan (MU(D)), Industrial Light (IL), Office and Institutional (OI), Office and Institutional with a Development Plan (OI(D)), Residential Suburban-20 (RS-20), Planned Development Residential (PDR), Residential Rural (RR), and Residential Suburban Multifamily with a Development Plan (RS-M(D)) to Compact Suburban Design - Core (CSD-C), Compact Suburban Design - Sub-District 1 (CSD-S1), Compact Suburban Design - Sub-District 2 (CSD-S2), and Residential Rural (RR). This zoning map change is associated with text amendment TC1800009 Compact Suburban Design District.


Street Closing

  • SC1800001 Oregon Street Closing (Continued from March 18, 2019): A request to permanently close 1,794.18 linear feet of Oregon Street.
